申诉，是指公民或者企业事业等单位，认为对某一问题的处理结果不正确，而向国家的有关机关申述理由，请求重新处理的行为。
诉讼上的申诉，申诉人申诉时，可以请律师予以帮助。对于民事案件和经济案件，还可以请律师担任代理人，代替申诉人申诉。对于非诉讼上的申诉，如果属于经济合同纠纷或者伤害赔偿等民事范围的问题，可用调解和仲裁方法解决的，根据《律师法》和《民事诉讼法》的规定，申诉人可以委托律师担任其代理人；对于其他问题的申诉，律师只能代写申诉书和提供法律、政策上的意见，却不能接受委托而担任代理人。
